All purchasing orders placed to Manhattan Experimental Records are submitted to the following general purchasing conditions.
The purchasing process is regulated by the current Spanish Law in long distance sales.
The Manhattan Experimental Records location is TEULERIES, 4, 25004 LLEIDA. You can also visit our web site www.manhattanrecords.net where you may find out all products and services we offer to our customers.

All prices exhibit in the products lists are including VAT tax. In the final purchase summary is shown the definitive price, pointing the tax base, the VAT tariff schedule and transport costs.
Related to the VAT Tax and as a general rule, will be applied the current tax rate of 18% to the territory of the European Union where it’s applicable this tax.
When the sale is to any other country of the world VAT will not be applied, despite the tariff customs that each country will apply of its own taxes.

In order to provide more security to the credit card owners, Visa has included a three digit number in their credit cards which is used as an identity code to verify the physical presence of credit card during the internet transactions. This three digit number is printed on Visa reverse (where is the signature), following the regular credit card number. In order to avoid illegal transactions with credit card, Manhattan Experimental Records reserves the right to ask our customers the digit control number before dispatching the goods.
The fraud with credit card is a computer crime, so Manhattan Experimental Records will prosecute against all people that realises a fraudulent transaction in our online store.
Manhattan Experimental Records makes a pursuit of each transaction and will use all measures available by the Law so that those people who make fraudulent purchases are sanctioned by the authorities.

It is very important that you indicate the order number, as well as your full name, and you have to make the transference in 7 days from Purchase Order (P.O.) date in order to validate it.
To process the order we need you to send by fax (+0034 973-228-867) the bank transfer receipt, and it will also has to be stated of effective form by our banking organization that has taken place the entrance. If you do not have a Fax or you wish to make any comment, you can send an e mail shop@manhattanrecords.net and we will be pleased to help you.
Please note that the currency payment is in Euros, and you must pay for all banking commissions of exchange due to you choose this payment system.
Manhattan Experimental Records reserves the right to change the delivery terms and the forwarder, whenever it does not suppose any damage for our client.

a) WITHOUT SHIPMENT (FOR COLLECTION)

This option won’t charge any transport cost to the total of the purchase, allowing to accumulate several orders, when they’re previously paid within the above stipulated terms. (See payment systems).

For purchases realised with the intention to accumulate o rders, which will be sent when you properly indicate it to us by mail to shop@manhattanrecords.net or by phone +00 34 973 24 17 94, and before a maximum term of 60 days from the first purchase order date. Once it’s overcome the term and we have no news from your part we will automatically send the goods without previous notice.
In both cases the shipment al will be by forwarder, freight collect. An Iberian Peninsula shipment up to 5 Kilos, that are 20 maxis, will have an approximated cost of 8 euros VAT included.

b) SHIPMENTS TO SPAIN AND PORTUGAL

Iberian Peninsula and Balearic Islands

*For all orders to Peninsula and Balearic Islands the delivery date will be within 3 to 5 working days for items catalogued as Vinyl and CD, and within 5 to 7 working days for the rest of items, if the P.O. is placed before 15.00h and it is available in stock. When the goods are not available we’ll send a confirmation date by e mail.

Canary Islands

*Bank Transfer or credit card payment. (See payment systems)
*The customer must pay the transport costs.
*The delivery date to Gran Canaria and Tenerife is within 3 to 5 working days for items catalogued as Vinyl and CD and within 5 to 7 working days for the rest of items. To the resting islands is 7 days.

*VAT tax will not be applied to Canary Islands sales despite the customs tariff will apply the corresponding taxes.

Ceuta and Melilla

*Bank Transfer or credit card payment. (See payment systems)
*The customer must pay the transport costs.
*The delivery date to Ceuta and Melilla is within 3 to 5 working days for items catalogued as Vinyl and CD and within 5 to 7 working days for the rest of items.
*VAT tax will not be applied to Ceuta and Melilla sales despite the customs tariff will apply the corresponding taxes.


c) SHIPMENTS TO THE FOREIGN COUNTRIES

* You can make your order from a foreign country or, even you order it from our country, you can indicate a foreign country as delivery address.
The corresponding taxes will be the carried by the consignee of the goods, according to the current laws in each country. Manhattan Experimental Records won’t be responsible for the payment of the own taxes of each country, custom tariffs or freight costs.
Bank Transfer or credit card payment. (See payment systems)
The customer must pay the transport costs.
The currency payment in credit cards is ALWAYS in Euros. We cannot apply the possible variations (in favour of the client or to our favour) of the EXCHANGE RATE when the customer is charged for the amount in its account.


IMPORTANT:

For shipments to non available countries we request they contact to shop@manhattanrecords.net in order to deal with each case personally.
*If the item has a manufacturing defect or there’s something wrong you can impute to Manhattan Experimental Records, you can return the item.
* When the product is not available in stock while to realise the P.O., the order will be pending until we receive it, or depending if the customer wants to change it for another item or for the money refund.
* The defects or flaws due to an incorrect use or manipulation of the material or the wear and tear produced by a normal use of it are not included in this guarantee.
* The loss in the functionality of items, because of the limitations of conception of the items itself, are also excluded from the cover of this guarantee.
* The products cannot be returned except for manufacturing defect.

*If when receiving the goods you’re not satisfied because of some of the reasons specified in the guarantee clause mentioned in point 4 of purchasing general conditions, you have a seven days term, from the date of reception, to execute the return right. (According to the Spanish Law: art. 44 de la Ley 7/1996, de 15 de Enero de Ordenación del Comercio Minorista).
*The shipment and collection costs in case of return because of defects of manufacture or errors imputable to the company will be charged to Manhattan Experimental Records.

* Once received the merchandise in our warehouse, and after checking its status, we will proceed to reimburse the amount according to the payment system realised by the client:

a)If the customer made the payment through credit card, the reimbursement will be in the same credit card.
b)If the customer made the payment by bank transfer, the reimbursement will be done in the account number given to us.
*Once received the goods in our warehouse, and after checking its status, the customer could change the defective product by a new equal product, or by any other product that the customer chooses, paying the difference based on the price of the new chosen product.
* If the buyer drops the right of claim does not imply a penalty, but he will have to compensate the flaws of the purchasing item.

These general conditions will be interpreted according to the current legislation in Spain, which will be applied subsidiary in all that hasn’t been regulated by these conditions. The location of the contract celebration will be presumed in LLEIDA (Spain), place that will determine the competent jurisdiction in the possible conflicts that could arise in the future.
